3. Getting Approval to Build
Good news for NSW homeowners! With the recently updated Housing State Environment Planning Policy, it is now possible to build a granny flat on your property without all of the red tape. As long as you meet certain requirements in terms of site and design – you can enjoy the streamlined Complying Development process with no need for council approval.

The NSW Government’s Housing SEPP makes it easier than ever for homeowners with a minimum 12m street frontage and at least 450 m2 of land area, to build the perfect secondary dwelling on their property.
It can now even go ahead without additional approval from councils, as long as some basic requirements are met. We have made the NSW secondary dwelling fact sheet available for download.
The requirements for approval for your granny flat as a “complying development” include:
- A minimum area of 450 m2
- Your block must have at least a 12m frontage
- Minimum setbacks (distances from)
- The rear of the block – 3m
- The side of the block – 0.9m
- Trees over 6m high – 3m
- Other buildings – 1.8m
- Property zone must be residential
- Maximum of 1 granny flat
- Maximum floor area for your granny flat – 60 m2
